Judge Frederic Block\u2019s\u00a0last-minute\u00a0decision puts on hold\u00a0a rule\u00a0that\u00a0was to have\u00a0taken\u00a0effect\u00a0Tuesday. Block wrote he\u00a0believes\u00a0the rule\u00a0may not be\u00a0enforceable\u00a0after the\u00a0June\u00a0Supreme Court\u00a0ruling\u00a0outlawing\u00a0workplace\u00a0discrimination\u00a0against\u00a0gays and\u00a0transgender men and women.\u00a0\u00a0\u00a0<\/p>\n

\u201cWhen the Supreme Court announces a major decision, it seems a sensible thing to pause and reflect on the decision\u2019s impact,\u201d Judge Block wrote\u00a0Monday. \u201cSince HHS (Health\u00a0and\u00a0Human Services) has been unwilling to take that path voluntarily, the court now imposes it.\u201d<\/p>\n

Block\u2019s decision\u00a0means\u00a0the new rule will be\u00a0reviewed\u00a0by the courts unless HHS\u00a0decides to scrap it.\u00a0<\/p>\n

The HHS regulation\u00a0would\u00a0have\u00a0stripped\u00a0health\u00a0care\u00a0protections\u00a0for transgender men and women that was\u00a0guaranteed\u00a0under\u00a0the\u00a0Affordable\u00a0Care Act \u2013 popularly\u00a0known\u00a0as Obamacare.\u00a0<\/p>\n

Analysts said\u00a0the HHS regulation was the Trump\u00a0administration’s\u00a0effort to appease\u00a0religious conservatives\u00a0upset over the\u00a0Supreme Court\u00a0ruling.\u00a0\u00a0<\/p>\n

Two transgender women\u00a0challenged\u00a0the regulation.\u00a0<\/p>\n

Democratic\u00a0Speaker\u00a0of the\u00a0House\u00a0Nancy Pelosi calls Judge Block\u2019s ruling a\u00a0\u201cvictory for the LGBTQ community and the rule of law.\u201d<\/p>\n
